Worst Prosecutor of 2006?
â€Good morning. Obviously, my name is Mary Lacy, and I am the elected district attorney for the 20th Judicial District.
As you are now aware, John Mark Karr, 41 years old, was arrested for the murder of JonBenét Ramsey yesterday morning at approximately 6 a.m. in Bangkok, Thailand.â€
or
â€Yesterday, based on evidence developed thus far in the investigation of the alleged sexual assault occurring at 610 N. Buchanan Boulevard in Durham, I submitted bills of indictment to the Grand Jury charging two members of the Duke University lacrosse team with the felonies of First Degree Rape, First Degree Sex Offense, and First Degree Kidnapping.â€
Then, after that politically annoying thing called “evidence,†we get this from Ms. Lacy, without the glee expressed in the first statement:
“His DNA does not match that found in the victim’s blood in her underwear. Prosecutors would not be able to establish that Mr. Karr committed this crime despite his repeated insistence that he did.â€
and this defiant statement from Mr. Nifong, after his “evidence†was found to be based on his political and class bias and prejudice:
"I am satisfied that she was sexually assaulted at this residence."
And the statement from the President of Duke, prosecuting the case as well, showed a large degree of class bias and prejudice:
“We can’t be surprised at the outpouring of outrage. Rape is the substitution of raw power for love, brutality for tenderness, and dehumanization for intimacy. It is also the crudest assertion of inequality, a way to show that the strong are superior to the weak and can rightfully use them as the objects of their pleasure.â€
At least Ms. Lacy stopped when the DNA evidence showed she had no case.
Mr. Nifong is continuing, using his position and power to show power, and “that the strong are superior to the weak and can rightfully use them as the objects of their pleasure.â€
So Mr. Nifong is awarded the title of “Worst Prosecutor of 2006.†Since the trial probably won’t happen until 2007, he is the front runner for next year, too.
As a prominent Duke law professor, James Coleman, said, "Either he knew what the facts were and misstated them, or he was making them up. Whether he acted knowing they were false, or if he was reckless, it doesn't matter in the long run. This is the kind of stuff that causes the public to lose confidence in the justice system."
Nifong was recently re-elected. That is the kind of thing that causes the justice system to lose confidence in the public.
